1. Acceptance of Terms
By accessing or using PromptlessPress ("the Service"), operated by PromptlessPress ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
PromptlessPress is an AI-powered platform that generates print-ready digital products, Etsy listing copy, and marketing materials for independent sellers. The Service uses third-party AI models including fal.ai and OpenAI APIs to generate content.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.
4. Credits and Billing
- The Service operates on a credit system. Credits are consumed when you generate products.
- Free plan users receive 30 credits upon signup. Paid plan credits are allocated monthly and do not roll over.
- All payments are processed securely by Stripe. We do not store your payment information.
- Subscriptions automatically renew unless cancelled before the renewal date.
- Credits are non-refundable once consumed. Unused credits on active subscriptions are not refundable upon cancellation.
5. Acceptable Use
You agree not to use the Service to:
- Generate content that infringes on third-party intellectual property rights, trademarks, or copyrights
- Create harmful, illegal, abusive, defamatory, or obscene content
- Resell, sublicense, or redistribute the Service itself
- Attempt to reverse-engineer or circumvent any security measures
- Use automated scripts to consume the Service in violation of fair use
6. Intellectual Property & Commercial Rights
Content generated by PromptlessPress using your inputs is yours to use commercially, including for sale on Etsy and other marketplaces. You represent that your use of generated content complies with applicable laws and Etsy's policies regarding AI-generated content disclosure.
PromptlessPress retains rights to the platform, software, and underlying technology. Generated outputs are not guaranteed to be unique or free from similarity to other AI-generated content.
7. AI-Generated Content Disclaimer
Our Service uses AI models to generate images and text. We do not guarantee: (a) the uniqueness of outputs; (b) freedom from copyright claims; (c) suitability for any specific platform or purpose. You are solely responsible for reviewing generated content before selling or distributing it.
Etsy disclosure requirement: Etsy requires sellers to disclose when listings contain AI-generated content. You are responsible for complying with Etsy's current policies on this matter.
8. Pricing & Market Data
Suggested prices and market data provided by PromptlessPress are estimates based on third-party research and AI analysis. They are updated monthly but are not guaranteed to be current or accurate. You are solely responsible for your own pricing decisions.
9. Limitation of Liability
To the maximum extent permitted by law, PromptlessPress shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
11. Termination
We reserve the right to suspend or terminate accounts that violate these Terms. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
12. Changes to Terms
We may update these Terms at any time. Significant changes will be notified by email or in-app notification. Continued use of the Service after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
